Welcome to PookaBook — our small, family-run bookshop in Scranton, Pennsylvania! We're so glad you're here. We hunt down beloved books and useful everyday finds — books first, always, with a few beauty and personal care favorites, handy electronics, home goods, and craft supplies shelved alongside — and we send them to readers all across the United States, every order packed by hand with care.
Overview
The terms "we", "us" and "our" refer to PookaBook. PookaBook operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). PookaBook is powered by Shopify Inc., Shopify Commerce Singapore Pte. Ltd. or Shopify International Limited, depending on where PookaBook is located, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service") describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our privacy policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services. These Terms of Service do not limit any rights you may have under applicable consumer protection laws or any other non-waivable statutory rights.
1. Access and account
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage. To use the Services, including accessing or browsing our little online bookshop or purchasing any of the books and goods we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our store is correct, current and complete and that you have all rights necessary to provide this information. You are solely responsible for maintaining the security of your account and for all activity under your account.
2. Our products
We have made every effort to provide an accurate representation of our products and services in our store — real photos, honest descriptions. Our shelves hold books first and foremost, along with beauty and personal care items, electronics, home goods, and arts and crafts supplies. The colors, editions, and packaging you see on screen can look a little different in person, but we describe everything as faithfully as we can.
3. Orders
When you place an order, you are making an offer to purchase and authorize us and our payment processors to charge your chosen payment method. PookaBook reserves the right to accept or decline your order for any reason at its discretion, subject to applicable law — we're a small shop, and sometimes a beloved title simply runs out. If we can't fulfill your order, we'll let you know promptly and refund you. We must receive and process your payment before your order is accepted. Please see our return and refund policy for details on returns. This does not limit any rights you may have under applicable law. You represent and warrant that you have the legal right to use any payment method you provide.
4. Prices and billing
Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price advertised at the time you place your order. We're a small family shop and we work hard to keep our prices fair and accurate — but if we make a typographical error in a price, we may cancel the affected order and refund you in full.
5. Shipping and delivery
Every order ships from our shop in Scranton, PA, United States, packed by hand with care. We process and pack orders within 1–2 business days; standard US delivery takes 3–5 business days after handling, and express US delivery takes 1–2 business days. Except as otherwise stated, we are not liable for shipping and delivery delays — once your package leaves our hands, timing is up to the carrier. All delivery times are estimates. 6. Intellectual property
Our Services, including all trademarks, brands, text, images, graphics, product layouts, the PookaBook name, and our little glowing-eyes logo, are the property of PookaBook, its affiliates or licensors and are protected by U.S. and foreign trademark, copyright and other intellectual property laws. The purchase or delivery of any product does not grant or confer any intellectual property rights to you or any third party. These Terms permit you to use the Services for your personal, non-commercial use only. You must not use our trademarks, logos, or content without our prior written permission. Unauthorized use of the Services may violate applicable intellectual property laws. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify.
7. Optional tools
You may be provided with access to customer tools offered by third parties as part of the Services, such as review tools or shipment trackers. These tools are provided "as is" and "as available" by their providers, and we have no control over them — your use of them is at your own risk.
8. Third-party links
The Services may contain materials and hyperlinks to websites provided or operated by third parties, such as payment providers or social platforms. We are not responsible for the content, accuracy, or practices of third-party sites, and we encourage you to review their terms before using them.
9. Relationship with Shopify
PookaBook is powered by Shopify, which enables us to provide the Services to you. When you use the Services, you acknowledge and agree that Shopify provides the commerce platform underlying our shop. Our agreement with you, however — the promises about your books, your orders, and your experience — is between you and PookaBook, our family-run bookshop. By using the Services, you acknowledge that Shopify is not responsible for the products and services we sell, including any injury, damage, or loss resulting from purchased products.
10. Privacy policy
Your privacy matters to us — you're our guest, and we treat your information with care. Our privacy policy explains how we may collect, use, and disclose certain personal information from your use of the Services. 11. Feedback
If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, or reviews — and we genuinely love hearing from our readers — you agree that we may use them for any purpose, including improving our shop, without restriction or compensation to you.
12. Errors, inaccuracies and omissions
Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies or omissions — a mispriced book, a misspelled title, a wrong edition listed. We're only human (and a small team at that), and we do our best to catch these. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Services is inaccurate, at any time without prior notice.
13. Prohibited uses
13.1 You may access and use the Services for lawful purposes only. You may not access or use the Services for any unlawful purpose, in violation of any laws, or to infringe the rights of PookaBook, Shopify or users of the Services, or expose them to liability.
13.2 In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code; (b) collect or track the personal information of others; (c) spam, phish, pharm, pretext, spider, crawl, or scrape; (d) interfere with or circumvent the security features of the Services; or (e) engage in any conduct that restricts or inhibits anyone's use of the Services.
14. Agents
14.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an automated agent to access or interact with the Services.
14.2 No Agent may access, use, or interact with the Services unless, at all times, it identifies itself as an agent and discloses the party on whose behalf it acts.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with the Services.
14.4 Agents must: (a) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose its principal; (b) comply with these Terms of Service; and (c) not circumvent any technical measures we employ.
15. Termination
We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion, at any time, with or without notice — though as a friendly neighborhood bookshop, we'd far rather work things out with you first. You may also stop using the Services at any time. All obligations and liabilities incurred before termination will survive.
16. Disclaimer of warranties
The information presented on or through the Services is made available solely for general information purposes. EXCEPT AS EXPRESSLY STATED BY PookaBook, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.
17. Limitation of liability
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL PookaBook, OUR FAMILY, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED THROUGH THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
18. Indemnification
You agree to indemnify, defend and hold harmless PookaBook, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, and licensors from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.
19. Severability
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service — the rest of the agreement remains in full force.
20. Waiver; entire agreement
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service, together with our return, shipping, and privacy policies, constitute the entire agreement between you and PookaBook regarding the Services.
21. Assignment
You may not delegate, transfer or assign this agreement or any of your rights or obligations under it without our prior written consent. We may assign our rights and obligations without restriction.
22. Governing law
These Terms are governed by the laws of the jurisdiction where PookaBook is headquartered — Scranton, Pennsylvania, United States — without regard to conflict-of-law principles. You and PookaBook consent to the jurisdiction and venue of the courts located in that jurisdiction, except where prohibited by applicable law.
23. Translations
The Terms of Service may be available in languages other than English. To the extent of any inconsistency between the English version and a translation, the English version will control, as determined by PookaBook in its sole discretion or as required by applicable law.
24. Headings
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
25. Electronic communications
By using the Services or placing an order, you agree that we may send you transactional and service-related communications electronically — order confirmations, shipping updates, and the like — to the email address you provide.
26. Changes to Terms of Service
You can review the most current version of the Terms of Service at any time on this page. We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.
